Public Lecture at the Indian Society of International Law on “Investor-State Dispute Resolution Reform.”
In the month of April 2023, Professor Steffen Hindelang was invited to address the Board and Members of the Indian Society of International Law (ISIL) to deliver a public-lecture on “Investor-State Dispute Resolution Reform.”
India is attempting to arrange replacements for several of the outdated international investment agreements it had dissolved. Finding the ideal balance between maintaining adequate regulatory flexibility and providing effective protection for foreign investment may not always prove to be simple.
The pros and cons of the various reform proposals were discussed. Professor Steffen Hindelang, recommended, among others, a flexible local remedies rule – doing away with inflexible fixed time limitations – similar to the one found in the European Court of Human Rights, which could solve the negotiation impasse in this regard. Professor Steffen Hindelang also delved more deeply into the power of interpretative agreements during the conversation, which could prove vital in keeping more regulatory space for pursuing legal social development and other public policy goals.
